Whether it is a workday or a weekend day, many individuals make early morning commutes to work, stores or getaway destinations. While there are many reasons to hit the road during the early hours of the day, some motorists might be en route to their home. Following a late night out at a bar, event or gathering could cause an individual to drive home during the early morning hours. However, these drivers are likely to have alcohol still in their system and could be the cause of a serious and even fatal drunk driving accident.

This is what unfortunately occurred in Baton Rouge recently. According to recent reports, a fatal crash occurred on North Sherwood Forest Boulevard around 6:25 a.m. near the 2000 block. Emergency crews transported the 40-year-old female to the hospital where she later passed.

Preliminary investigation suggests that the accident happened when a 41-year-old male driving a GMC Sierra turn northbound on North Sherwood Forest Blvd. from a side street in the southbound lane and into oncoming traffic. Tis resulted in him colliding head on with a Chevy Impala. Authorities at the accident site claim that the driver of the Sierra was extremely intoxicated with a strong odor of alcohol around his person. They additionally reported that his eyes were blood shot, his speech was slurred and he had poor balance.

The male driver was charged with vehicular homicide, DWI second offense and reckless operation of a motor vehicle. Authorities reported that he was arrested for a prior DWI in December of 2015 and currently does not have a driver’s license. The accident is still under investigation and it is not clear if the driver will face additional charges for this accident.

In addition to facing criminal penalties, a drunk driving could endure civil liabilities. Following a fatal drunk driving accident, loved ones of the deceased could file a wrongful death suit. This not only places accountability on the negligent driver but also helps with the recovery of compensation for losses and damages.
